German Exam Failure Rules: Freischuss, Retakes, and Exmatrikulation

Germany’s exam system has strict rules about failure, retakes, and what happens if you fail too many times. Understanding this before you fail (ideally) or immediately after (realistically) determines your options and timeline.

Prüfungsversuche (Exam Attempts)

Most German university modules allow 3 attempts at an exam. The first failure doesn’t harm you. The second failure triggers administrative attention at many universities. A third failure (Drittversuch) in a Pflichtfach (compulsory module) at many universities leads to Exmatrikulation (de-enrollment) from the program — you can’t take the exam again and are removed from the program. Some universities allow appeal processes; others don’t.

This rule varies significantly by university and program. Read your Prüfungsordnung (examination regulations) carefully — especially the sections on Wiederholungsprüfungen (repeat examinations) and Bestehensvoraussetzungen (passing requirements).

The Freischuss Rule

Some German universities (particularly older technical universities) have a Freischuss rule: if you take an exam voluntarily in the first possible semester you’re eligible and fail, it doesn’t count as an attempt (it’s “free”). This allows you to test your readiness without risk. Not all programs have this rule; verify in your Prüfungsordnung before relying on it.

Rücktritt (Withdrawal)

You can withdraw from a registered exam without penalty (and without it counting as an attempt) up to a specific deadline — usually a week before the exam. After this deadline, withdrawal requires documentation of Krankheit (illness) confirmed by a Attest (doctor’s certificate), personal emergency, or other formally accepted reasons. Withdrawing without accepted documentation = failure (Nichterscheinen, non-appearance, treated as failed attempt).

Illness and Exams

If you’re ill on exam day, get a doctor’s certificate (Attest or ärztliches Attest) from a Arzt that day. Take it to your Prüfungsamt (examination office) within 3 days. This is time-sensitive — most universities don’t accept retroactive illness documentation. The exam attempt is then not counted and you get another opportunity.

If You’ve Failed Three Times

Seek advice immediately from your Studienberatung (student counseling) and your AStA (student union). Some programs have appeal processes; some allow exceptions for documented extenuating circumstances. Acting quickly (within days, not weeks) is critical. A student union advisor familiar with your university’s Prüfungsordnung can tell you what options exist that aren’t obvious from the regulations text.
